Please read these Terms carefully. By downloading, installing, or using the GuardUp app, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and GuardUp ("we", "us", or "our") governing your access to and use of the GuardUp mobile application and any related services (the "Service").
By accessing or using the Service you confirm that: (a) you have read and understood these Terms; (b) you are at least 13 years of age; and (c) you have the legal authority to enter into this agreement.
2. Eligibility
The Service is intended for users aged 13 and older. If you are between the ages of 13 and 18, you represent that you have your parent or legal guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.
We do not knowingly permit individuals under 13 to use the Service. If we discover that a user is under 13, we will delete their account immediately.
3. Account Registration
To access most features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Keep your password confidential and not share it with anyone.
- Immediately notify us of any unauthorised use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Subscriptions and Billing
4.1 GuardUp Pro
GuardUp offers a premium subscription plan — GuardUp Pro — at $9.99 per month. GuardUp Pro provides access to additional features including unlimited AI coaching, advanced analytics, competition prep tools, and unlimited profiles.
4.2 Free Trial
New subscribers may receive a 7-day free trial of GuardUp Pro. The trial period and eligibility are determined by the applicable App Store or Google Play rules. You will not be charged during the trial period. After the trial ends, your subscription automatically converts to a paid subscription unless you cancel before the trial period expires.
4.3 Billing and Renewal
Subscriptions are billed on a monthly basis through your Apple App Store or Google Play account. Your subscription automatically renews each month unless you cancel at least 24 hours before the end of the current billing period. The renewal charge will be applied to your App Store or Google Play account within 24 hours before the end of the current period.
4.4 Cancellation
You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then. We do not offer partial refunds for unused time within a billing period.
4.5 Refunds
All purchases are final and processed by Apple or Google. Refund requests must be submitted directly to Apple (via reportaproblem.apple.com) or Google (via the Google Play support page). We are unable to process refunds directly.
4.6 Price Changes
We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes through the App or by email. Continued use of the Service after a price change constitutes your agreement to the new price.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable local, national, or international laws or regulations.
- Attempt to reverse engineer, decompile, or disassemble the App.
- Use automated means (bots, scrapers, etc.) to access the Service.
- Upload or transmit any content that is harmful, offensive, defamatory, or infringes any third-party rights.
- Attempt to gain unauthorised access to any part of the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Share your account credentials with others or allow multiple people to use a single account.
6. User Content
You retain ownership of the training logs, notes, and other content you create within the App ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to use your User Content solely to provide and improve the Service.
We do not sell or share identifiable User Content with third parties. Anonymised, aggregate data derived from User Content may be used for analytics and product improvement.
You are solely responsible for your User Content. We reserve the right to remove any content that violates these Terms.
7. AI Coaching Disclaimer
Important: The AI coaching and recommendations provided by GuardUp are for informational and training guidance purposes only. They do not constitute professional medical, physiotherapy, or sports medicine advice. Always consult a qualified professional before beginning any new training programme, especially if you have an existing injury or health condition.
GuardUp's AI responses are generated algorithmically and may contain inaccuracies. You use AI coaching recommendations at your own risk.
8. Intellectual Property
The Service, including its design, code, content, logos, and trademarks, is owned by GuardUp or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes only.
Nothing in these Terms grants you any right to use the GuardUp name, logo, or trademarks without our prior written consent.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. You assume all risk for any damage to your device or data arising from your use of the Service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUARDUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $10 (USD), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless GuardUp and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service immediately ceases.
You may delete your account at any time within the App (Settings → Danger Zone → Delete Account). Deletion is irreversible and will permanently remove all your data.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in [Your Jurisdiction].
15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by in-app notification or email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GuardUp with respect to the Service and supersede all prior agreements and understandings.
